Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, applications, API, and services provided by Verbatik Technologies Limited (“Verbatik AI”, “we”, “us”). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. Notify us promptly of any unauthorised use.

2. The Services

Verbatik AI provides AI-powered creative tools including text-to-speech, voice cloning, AI video and avatar generation, music and sound effects, image generation and editing, transcription, and related features, in many languages. We may add, change, or discontinue features at any time.

3. Plans, credits & payment

• Paid plans and credit packs are billed through Stripe according to the pricing shown at checkout. Subscriptions renew automatically until cancelled.
• You authorise us to charge your payment method for applicable fees and taxes. Prices may change with notice for future billing periods.
• You can cancel at any time; cancellation takes effect at the end of the current billing period. Refunds are governed by our Refund Policy.
• Credits and usage allowances may expire as described in your plan.

4. Your content

“Your Content” means the text, prompts, audio, images, voice samples, and other materials you submit. You retain ownership of Your Content. You grant us a limited licence to host, process, and transmit it to our AI providers solely to operate the Services and deliver your outputs. Subject to your plan, you own the media you generate, to the extent permitted by law.

5. Voice cloning & likeness

You may only clone or synthesise a voice that is your own or for which you hold explicit, documented permission from the rights holder. You are solely responsible for obtaining all necessary consents. You must not use voice cloning to impersonate, defraud, harass, or create misleading content.

6. Acceptable use

You agree not to use the Services to:

• Break the law or infringe others’ rights, including intellectual property and privacy.
• Create deceptive, defamatory, hateful, harassing, or harmful content.
• Generate sexual content involving minors or non-consensual intimate content.
• Impersonate any person or misrepresent your affiliation.
• Produce spam, malware, fraud, or election or health misinformation.
• Reverse engineer, scrape, overload, or circumvent the Services’ technical limits or security.
• Resell or expose the Services in violation of these Terms or your plan.

We may suspend or terminate accounts that violate these rules and remove offending content.

7. API use

Use of our API is subject to these Terms, any documented rate limits, and the plan you purchase. Keep your API tokens confidential; you are responsible for activity carried out with your tokens.

8. Intellectual property

The Services, including software, models, branding, and content we provide, are owned by Verbatik Technologies Limited or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Services as permitted by these Terms.

9. Third-party services

The Services rely on third-party providers (for example payment, hosting, and AI model providers). Your use may also be subject to their terms. We are not responsible for third-party services we do not control.

10. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. AI outputs may be inaccurate or unexpected; you are responsible for reviewing them before use. See our Disclaimer.

11. Limitation of liability

To the maximum extent permitted by law, Verbatik Technologies Limited will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Services will not exceed the amount you paid us in the 12 months before the event giving rise to the claim.

12. Indemnity

You agree to indemnify and hold Verbatik Technologies Limited harmless from claims and costs arising out of Your Content, your use of the Services, or your breach of these Terms or applicable law.

13. Termination

You may stop using the Services and close your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Services or other users. On termination, your right to use the Services ends; certain provisions survive termination.

14. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except where mandatory local consumer law provides otherwise.

15. Changes

We may update these Terms. We will post the updated version with a new “Last updated” date and, for material changes, provide reasonable notice. Continued use after changes take effect constitutes acceptance.
